A woman whose daughter suffered a severely debilitating birth injury has settled her lawsuit against the delivering doctors and the hospital where the delivery occurred for $9.5 million.
As a result of the doctors’ medical malpractice, the suit claims, the baby girl, Da’Janae, was born with severe cerebral palsy, a seizure disorder, and spastic quadriplegia.
The lawsuit was filed by Tanisha Grant, as mother of Da’Janae Baker, against John C. Holanday, R.N., Beth Lopez, M.D., Gina Laraine Smith, M.D. Mark P. Macumber, M.D., and the West Suburban Hospital Medical Care Center in Illinois.
The Incident
According to the lawsuit Tanisha Grant went to the West Suburban Clinic for a routine prenatal checkup. She was admitted, and the medical staff attached a fetal monitor. The doctors determined that it was best to induce labor with Pitocin.
Early the next day, Tanisha started dilating and was administered an epidural. She was fully dilated by approximately 10 p.m. that night. She pushed for hours with no progress. Tanisha experienced episodes of hyperstimulation of the uterus, and there were large fluctuations in fetal heart rate. The fetal monitor showed signs revealing fetal distress.
According to the lawsuit, the doctors failed to recognize the significance of these symptoms and act on them to prevent injury to the baby.
The Birth
The following morning at 2:51 a.m. on October 24, 2001, after hours of unsuccessful labor, the doctors performed a c-section.
When Da’Janae was born, she was depressed and not breathing. She was soon transferred to Children’s Memorial Hospital, where doctors diagnosed her with spastic quadriplegia, cerebral palsy, and a seizure disorder, which can all be attributed to a lack of oxygen to the brain during childbirth.
