$4.35M Settlement Reached in Slip and Fall Suit

A settlement was recently reached in Tulare County, California in the slip and fall case filed against Lowe’s Home Improvement.

The plaintiff filed that suit after she fell and suffered from injuries at a store located near north Visalia last year.

Woman Takes Harmful Fall

Maria Senaida Garcia, 71, was reportedly browsing for flowers at the local Lowe’s store when she slipped on a garden hose left out by employees.

Garcia broke her arm and hit her head in the incident, and as a result suffered a stroke and is now paralyzed on one side of her body.

Victim Files Lawsuit

After being hospitalized and suffering a great deal from her injuries, Garcia filed a lawsuit against the store claiming they were negligent.

According to her son, Rudy Garcia, the event has taken a toll on the entire family and his mother has been forced to live in an assisted living home.

The suit was settled shortly after it was filed and Garcia was awarded $4.35 million for her injuries.

“We are very pleased with the settlement,” says Garcia’s attorney, Ken Fitzgerald.
