An Illinois construction worker filed a spinal injury lawsuit against Keller Construction and Dayton Superior Corporation after falling off a piece of scaffolding Dec. 22, 2006.
Gene Birdsell filed the lawsuit Sept. 15 in Madison County Circuit Court, seeking compensation for financial, physical and emotional damage resulting from the construction accident. According to the lawsuit, Birdsell was working on the Sugar Fork Creek Bridge when the scaffolding collapsed.
Lawsuit Accuses Defendants of Negligence
The lawsuit accuses Keller Construction of negligence because it allowed Birdsell to work in an unsafe environment and “allowed him to stand on improperly assembled scaffolding.”
Negligence claims have also been filed against Dayton Superior Corporation for manufacturing a defective product and failing to warn users of possible danger. The suit also accuses the company of using bolts of inadequate strength in the production of the product.
Seeking Compensation for Negligence
Birdsell is seeking compensation for medical costs, lost wages and pain and suffering caused by the negligence of the two companies. Birdsell is seeking $150,000 in addition to compensatory damages, which include the cost of the lawsuit.
