Family Files Suit After Mining Accident

A family in Indiana recently filed suit on behalf of a man who they claim wrongfully died while he was working.

The lawsuit has been filed against Frontier-Kemper Constructors Inc. and claims they were negligent for not enforcing stronger safety measures.

Man Plunges to Death

Daniel McFadden, 66, was working as a miner for Frontier Kemper when he and two other workers fell more than 500 feet in a coal mine’s air shaft.

According to the complaint, the company failed to provide safety belts or harnesses for the workers.

The family argues that a sling and shackle attached to the bucket carrying the men should have been removed when they entered the bucket.

Family Files Suit

McFadden’s family filed a suit following the incident against the company on his behalf.

They are reportedly seeking $9.5 million for the wrongful death of their loved one and to compensate for funeral expenses and other damages.
