A woman, who allegedly slipped and fell in a Beaumont, Texas McDonald’s is suing the fast food restaurant for negligence. According to the suit, even though it was raining outside, there should have been “caution” signs posted in the restaurant, warning that the ground was wet.
"It had been raining for a considerable time... (but) there were no warning signs, no wet floor signs and no non-slip surface or rug in place to warn plaintiff," reads the lawsuit.
Adrienne Casimire filed the slip and fall lawsuit this month in the Jefferson County court.
Slip and Fall Suit Raises Suspicion
Reporters have raised the question: Shouldn’t she have known the floor was wet and slippery, given the rain?
“When you know "it had been raining for a considerable time" and you're exiting your car onto soaked surfaces, shouldn't that cue caution?” argued a Southeast Texas Record reporter.
Despite criticism from local reporters, Casimire’s attorney says he feels McDonald’s failure to post “caution” signs was an act of negligence, making the corporation liable for Casimire’s injuries. Casimere claims she injured her back and knees in the fall, and is suing McDonald’s for medical expenses and mental anguish.
Slip and Fall Cases Get Expensive
According to the National Floor and Safety Institute (NFSI), slip and fall cases can be rather expensive. A company like McDonald’s will spend an average of $50,000 to defend cases such as these, reports the NFSI. If the case ends up going to trial, the price tag may increase to sums close to $100,000.
In the case of slip and falls lawsuits, most companies try to settle before going to trial to save the extra costs and time. However, whether Casimire will opt to settle has not yet been determined.
